Estes Termos de Uso ("Termos") regulam o acesso e uso do website e dos serviços operados por [Razão Social], pessoa jurídica de direito privado inscrita no CNPJ sob nº [CNPJ], com sede em [Endereço] ("nós", "empresa"). Ao utilizar o website ou contratar os produtos, você ("usuário") concorda com estes Termos. Aplicam-se o Código Civil (Lei 10.406/2002), o Código de Defesa do Consumidor (Lei 8.078/1990), a LGPD (Lei 13.709/2018) e o Marco Civil da Internet (Lei 12.965/2014).

3.1 Definição do Serviço

Oferecemos um serviço digital de informação ("Serviço") composto por:

PDF personalizado com roteiro de prorrogação de estadia turística no Brasil, gerado a partir das informações do formulário de elegibilidade;
Checklist de documentos específica do perfil;
E-mails transacionais com lembretes do cronograma;
Priority Support opcional (perguntas por e-mail, conforme plano contratado).

Não protocolamos, não representamos e não peticionamos o pedido junto à Polícia Federal. Ver Aviso Legal.

3.2 Natureza do Serviço — NÃO é intermediação migratória

Para afastar qualquer dúvida: o Serviço é conteúdo informativo de natureza educacional, sem intermediação migratória nem prática de advocacia. Especificamente:

Não praticamos advocacia nos termos da Lei 8.906/1994 (EOAB): não emitimos parecer jurídico, não postulamos em qualquer instância, não representamos o usuário em procedimento administrativo ou judicial.
Não prestamos intermediação migratória nos termos da Lei 13.445/2017 e do Decreto 9.199/2017: não protocolamos, não assinamos, não comparecemos, não negociamos com a autoridade migratória em nome do usuário.
Categoria equivalente: nosso produto é comparável a um guia de viagem editorial personalizado — um travel guidebook — cuja liberdade de produção e venda não depende de inscrição na OAB nem de licença migratória.

Caso a autoridade competente entenda, em algum momento, que parcela do Serviço demande licenciamento específico, ajustaremos o escopo e/ou obteremos o registro cabível.

3.3 Elegibilidade para uso

Você pode usar o Serviço se:

Tem 18 anos ou mais, ou utiliza sob supervisão de responsável legal;
Entrou no Brasil em regime de isenção de visto de turismo qualificado;
Está dentro do prazo autorizado no momento da contratação;
Fornece informações verdadeiras.

Reservamos o direito de recusar, cancelar ou não entregar se identificarmos (antes ou depois do pagamento) que as condições não são atendidas. Nesse caso há direito a reembolso integral conforme 3.5.

3.4 Pagamento e NFSe

Preços exibidos em USD via Stripe. Ao contratar, você autoriza a Stripe a debitar o valor integral no meio de pagamento escolhido. Emitimos NFSe em BRL no câmbio do dia da contratação, com recolhimento de ISS (Imposto Sobre Serviços) no município de [Cidade Foro] conforme alíquota vigente. As vendas são definitivas ressalvado o disposto em 3.5 e na Política de Reembolso.

3.5 Política de reembolso (resumo)

Reembolso integral se marcado NÃO ELEGÍVEL antes do pagamento.
Reembolso integral se falha técnica nossa impedir a entrega.
Direito de arrependimento (art. 49 CDC): 7 dias a contar da contratação, desde que o usuário declare que não utilizou o conteúdo.
Sem reembolso após 7 dias da entrega.
Sem reembolso em caso de indeferimento pela Polícia Federal (decisão estatal; caso fortuito nos termos do art. 393 do Código Civil).

3.6 Limitação de responsabilidade

Nos limites da lei, incluindo as regras de ordem pública do CDC:

O Serviço é fornecido "no estado em que se encontra", sem garantias além das expressas nestes Termos e das legalmente exigidas.
Não respondemos pela decisão da Polícia Federal. Indeferimento ou demora na decisão não caracterizam descumprimento contratual, por se tratar de ato estatal discricionário — caso fortuito/força maior nos termos do art. 393 do Código Civil.
Não respondemos por danos indiretos, lucros cessantes, passagens remarcadas, multas migratórias ou danos morais decorrentes de decisão da PF.
A responsabilidade agregada limita-se ao valor efetivamente pago nos 12 meses anteriores ao fato, ressalvados dolo e culpa grave e as regras de ordem pública do CDC (arts. 24, 25 e 51), que prevalecem.
Nada nestes Termos afasta responsabilidade por fraude, dolo ou hipóteses em que a limitação seja vedada por lei.

3.7 Propriedade intelectual

Todo o conteúdo do website, a marca e o PDF personalizado são de titularidade da [Razão Social] ou de seus licenciantes, nos termos da Lei 9.610/1998 (Direitos Autorais) e da Lei 9.279/1996 (Propriedade Industrial). Mediante pagamento, o usuário recebe licença pessoal, não exclusiva, intransferível e não sublicenciável para uso em uma única tentativa de prorrogação. É vedado:

Revender, redistribuir, publicar ou compartilhar o PDF com terceiros;
Usar o PDF para prestar serviços a outros;
Remover marcas d'água, créditos ou identificação;
Utilizar o conteúdo para treinar modelos de aprendizado de máquina sem autorização escrita.

3.8 Obrigações do usuário

Você se compromete a:

Prestar informações verdadeiras, atuais e completas no formulário e no checkout;
Usar o Serviço apenas para sua própria prorrogação, não em nome de terceiros;
Comparecer pessoalmente ao agendamento da Polícia Federal;
Não usar o Serviço de forma indevida (scraping, engenharia reversa, finalidade ilícita);
Cumprir a legislação migratória brasileira e as leis da sua jurisdição.

Você é o único responsável pela veracidade das informações prestadas à PF e pelo desfecho do pedido.

3.9 Suspensão e rescisão

Podemos suspender ou encerrar o acesso e recusar a entrega se houver descumprimento, informação falsa ou exigência legal. Em caso de rescisão por nossa iniciativa sem justa causa do usuário, cabe reembolso conforme 3.5. A rescisão não afeta direitos adquiridos nem cláusulas de natureza permanente (PI, responsabilidade, foro).

3.10 Lei aplicável e foro

Aplicam-se as leis da República Federativa do Brasil. Fica eleito o foro da Comarca de [Cidade Foro], com exclusão de qualquer outro, ressalvadas as regras do CDC que facultam ao consumidor demandar em seu domicílio (art. 101, I, CDC).

3.11 Alterações

Podemos atualizar os Termos. A "Data de vigência" no topo refletirá a versão mais recente. Alterações materiais serão comunicadas por e-mail aos clientes ativos. O uso após a alteração implica aceite.

Terms of Service

These Terms of Service ("Terms") govern access to and use of the website and services operated by [Razão Social], a Brazilian company registered under CNPJ [CNPJ], with registered office at [Endereço] ("we", "the company"). By using the website or purchasing our products, you ("user") agree to these Terms. The Brazilian Civil Code (Law 10.406/2002), the Consumer Protection Code (Law 8.078/1990), the LGPD (Law 13.709/2018) and the Marco Civil da Internet (Law 12.965/2014) apply.

3.1 Definition of the Service

We offer a digital information service ("Service") consisting of:

A personalized PDF roadmap for Brazilian tourist-stay extension, generated from the eligibility form inputs;
A profile-specific document checklist;
Transactional e-mails with schedule reminders;
Optional Priority Support (e-mail Q&A, per plan).

We do not file, do not represent, and do not petition on your behalf before the Brazilian Federal Police. See Disclaimer.

3.2 Nature of the Service — NOT immigration brokerage

To remove any doubt: the Service is informational content of educational nature, not immigration brokerage nor the practice of law. Specifically:

We do not practice law under Brazilian Law 8.906/1994 (EOAB): no legal opinions, no litigation, no representation before any authority.
We do not provide migration brokerage under Law 13.445/2017 and Decree 9.199/2017: no filing, no signing, no in-person appearance, no negotiation with the migration authority on your behalf.
Category equivalence: our product is comparable to a personalized editorial travel guidebook — the sale of which does not require OAB bar registration or a migration license.

If the competent authority at any time considers that a portion of the Service requires specific licensing, we will adjust scope and/or obtain the relevant registration.

3.3 Eligibility to use

You may use the Service if:

You are 18 or older, or use it under the supervision of a legal guardian;
You entered Brazil under a qualifying tourist visa-exemption regime;
You are within the authorized stay period at the time of purchase;
You provide truthful information.

We reserve the right to refuse, cancel or not deliver if we identify (before or after payment) that conditions are not met. A full refund applies in that case per 3.5.

3.4 Payment and NFSe

Prices are displayed in USD via Stripe. On purchase you authorize Stripe to charge the full amount to your chosen method. We issue a Brazilian electronic service invoice (NFSe) in BRL at the exchange rate of the purchase day, with collection of ISS (municipal service tax) in [Cidade Foro] at the applicable rate. All sales are final subject to 3.5 and to the Refund Policy.

3.5 Refund policy (summary)

Full refund if flagged NOT ELIGIBLE before payment.
Full refund if a technical failure on our side prevents delivery.
Right of withdrawal (art. 49 CDC): 7 days from purchase, provided you declare you have not used the content.
No refund after 7 days from delivery.
No refund if the Federal Police denies your request (state act; force majeure under art. 393 of the Civil Code).

3.6 Limitation of liability

To the extent permitted by law, including public-order rules of the Brazilian Consumer Code:

The Service is provided "as is", without warranties beyond those expressed in these Terms and those required by law.
We are not liable for the decision of the Federal Police. A denial or delay does not amount to breach of contract — it is a discretionary state act, force majeure under art. 393 of the Brazilian Civil Code.
We are not liable for indirect damages, lost profits, rebooked flights, migration fines or moral damages arising from PF decisions.
Aggregate liability is capped at amounts actually paid in the 12 months preceding the event, except for fraud or gross negligence and except where public-order rules of the CDC (arts. 24, 25 and 51) prevail.
Nothing in these Terms waives liability for fraud, wilful misconduct, or where limitation is barred by law.

3.7 Intellectual property

All website content, the brand and the personalized PDF are owned by [Razão Social] or its licensors under Law 9.610/1998 (Copyright) and Law 9.279/1996 (Industrial Property). Upon payment, the user receives a personal, non-exclusive, non-transferable, non-sublicensable license for use in a single extension attempt. It is prohibited to:

Resell, redistribute, publish or share the PDF with third parties;
Use the PDF to provide services to others;
Remove watermarks, credits or identification;
Use the content to train machine-learning models without written authorization.

3.8 User obligations

You undertake to:

Provide truthful, current and complete information at the form and checkout;
Use the Service only for your own extension, not on behalf of third parties;
Appear in person at the Federal Police appointment;
Not abuse the Service (scraping, reverse engineering, unlawful purpose);
Comply with Brazilian migration law and the laws of your jurisdiction.

You are solely responsible for the truthfulness of the information given to the Federal Police and for the outcome of your request.

3.9 Suspension and termination

We may suspend or terminate access and refuse delivery in case of breach, false information or legal requirement. If we terminate without user fault, refunds apply per 3.5. Termination does not affect acquired rights nor permanent clauses (IP, liability, venue).

3.10 Governing law and venue

The laws of the Federative Republic of Brazil apply. The courts of [Cidade Foro] are elected, to the exclusion of any other, except where the CDC grants the consumer the right to sue at their own domicile (art. 101, I, CDC).

3.11 Changes

We may update the Terms. The "Effective date" at the top reflects the latest version. Material changes will be communicated by e-mail to active customers. Continued use after the change implies acceptance.
